GENERAL TERMS OF USE

1. IDENTIFYING DATA

In compliance with the duty of information contained in article 10 of the 34/2002 Act, of 11th July, on Information Society and Electronic Commerce Services, the following data is publicised: the mercantile proprietor of www.theolivetreepinoso.com (“the Site”), is The Olive Tree, with registered office in Calle Francisco de Quevedo 10ª C.P. 03650, Pinoso (Alicante) with NIE. X4422324E.

2. USERS

The access and/or use of the portals of The Olive Tree is recognised as the USER, who accepts, from this access and/or usage, the general conditions of use hereby reflected. The mentioned conditions shall apply independently of the Service Agreement Terms and Conditions which, where appropriate, are binding.

3. USE OF THE PORTAL

The Site provides access to a multitude of information, services, programs or data (hereinafter "the contents") on the Internet site belonging to The Olive Tree or to its licensors, to which the user can have access. The USER assumes responsibility for the use of the Site. This responsibility extends to the registration necessary to access certain services or contents. With this registration the USER will be responsible for providing truthful and lawful information. As a result of this registration, the USER will be provided with a password of which he/she will be responsible for, committing to make a diligent and confidential use of it. The USER agrees to make an adequate use of the contents and services that The Olive Tree offers through its Site, restricted to not use them (i) for incurring in illicit or illegal activities, as well as activities that are contrary to good faith and/or Public Order; (ii) to spread content or propaganda of a racist, xenophobic, pornographic-illegal nature, advocacy of terrorism or of a human rights attack; (iii) to cause damage to the physical and logical systems of The Olive Tree, its suppliers or third parties, introduce or disseminate in the network computer viruses or any other physical or logical systems that are susceptible to causing the damage mentioned above; (iv) to try to access and, where appropriate, use the email accounts of other USERS and modify or manipulate their messages. The Olive Tree reserves the right to withdraw all comments and contributions that violate respect for the dignity of a person or persons, which are discriminatory, xenophobic, racist, pornographic, that threaten young people or children, violate a Public Order or Public safety or which, in their view, would not be appropriate for publication. In any case, The Olive Tree will not be responsible for the opinions expressed by the USERS through forums, public chat rooms, social media sites, or other tools of participation.

4. DATA PROTECTION

The Olive Tree complies with the guidelines of the European Regulation on data protection 679/2016 currently in force since 25th May 2018, and ensures the correct use and handling of the USER'S personal data. To this end, The Olive Tree, together with each form completed and with each service contracted, informs the USER of: the existence and acceptance of the particular conditions of the treatment of their data in each case; the duties of the files created; the address of the person responsible; the possibility of exercising rights of access, rectification, cancellation or opposition and the purpose of the handling and the management of the data to third parties, if applicable. Likewise, The Olive Tree confirms that it complies with the 34/2002 Act of 11th July, Information Society and Electronic Commerce Services and will request consent to the treatment of electronic email for commercial purposes.

5. INTELLECTUAL AND INDUSTRIAL PROPERTY

The Olive Tree by itself or as assignees, own all the intellectual and industrial property rights of its Web pages, as well as the elements contained in them (for the purposes of: images, sound, audio, video, software or texts; trademarks or logos, colour combinations, structure and design, selection of used materials, computer programs necessary for its operation, access and use, etc.), and that it is owned by The Olive Tree or by its licensors, all rights reserved. Pursuant to articles 8 and 32.1, second subparagraph, of the Intellectual Property Act, it is strictly prohibited to: reproduce, distribute and/or publicly communicate, including their method of making available, all or part of the contents of this website, for any commercial purposes, by any device and by any technical means, without the authorisation of The Olive Tree The user agrees to respect the Intellectual and Industrial Property Rights owned by The Olive Tree The elements of the Site can be printed off, copied and stored on a computer's hard drive or any other physical device as long as it is only, and exclusively, for personal and private use. The USER must refrain from deleting, altering, circumventing or tampering with any protection device or security system that was installed on the pages of The Olive Tree By sending or uploading data to the Site, the USER authorises The Olive Tree to reproduce, distribute, transform and publically transfer any of its content, as well as the authority to use it in any price reports, property search reports, historical references of the real estate market, valuations and surveys, yielding a licence with worldwide effect, with the ability to sublicense to associate companies and third parties and for the maximum period of protection allowed by law. 6. DISCLAIMER OF WARRANTIES AND LIABILITY

The Olive Tree is not responsible, in any case, for damages of any nature that may arise from the use of the Site, such as: errors or omissions in the contents in the Site; lack of availability of the portal or the transmission of viruses or malicious or harmful programs in the contents, despite having taken all the technological measures necessary to avoid it; the validity and/or adequacy of any content, information, image or data provided by a USER advertising a property for sale, or for its availability, legitimacy, legality or location. The USER declares not to use images or words that can be considered offensive or abusive, nor to use a language that is in any way considered denigrating, offensive or of a sensitive nature.

7. MODIFICATIONS

The Olive Tree reserves the right to make, without prior notice, modifications to the Site that it deems appropriate - being able to change, delete and/or add the content and/or services provided and the way in which they are presented or located on the Site.

8. USE OF COOKIES

The Olive Tree will be able to use cookies to personalise and ease the USER'S navigation on its Site. Cookies are only associated with an anonymous USER and his/her computer and do not provide references that allow the USER to deduct personal data. The USER will be able to configure his/her browser to notify and reject the installation of the cookies sent by The Olive Tree, without damaging the USER'S ability to access the contents.

9. LINKS

In the event that the Site contains links or hyperlinks to other Internet sites, The Olive Tree will not exercise any control over such sites and its content. In no event will The Olive Tree assume any responsibility for the contents of any link belonging to an external website, nor will it guarantee the technical availability, quality, reliability, accuracy, coverage, veracity, validity and constitutionality of any material or information contained in any such hyperlink or other website. Likewise, the inclusion of these external connections will not imply any type of association, merger or participation with the connected entities.

10. RIGHT OF EXCLUSION

The Olive Tree reserves the right to deny or withdraw access to its Site and/or the services offered without prior notice, at its own request or by a third party, to those USERS who do not comply with these general conditions of use.

11. GENREAL USE

The Olive Tree will pursue the breach of these conditions as well as any improper use of its Site exercising any civil and penal actions that may apply, by law.

12. MODIFICATION OF THE PRESENT CONDITIONS AND DURATION

The Olive Tree may modify the conditions hereby stated at any time, being duly published as shown here. The validity of the aforementioned conditions shall be in accordance with their exposure and will be in force until they are amended and duly published.

The English version of this agreement is provided for guidance purposes only, and in all instances, only the Spanish original will form the basis of the legal agreement, which can be read on the Spanish version of the Website.
